ELECTRONIC STABILITY CONTROL (ESC), SERVICE BRAKES
The contact owns a 2023 BMW X1. The contact stated that while reversing out of a parking space at slow speeds, there was an abnormal thud, prompting the contact to depress the brake. The contact then became aware that the brake was not functioning properly. The contact stated that the brake pedal depressed all the way the floorboard before the vehicle came to a complete stop. The service brake and check engine warning lights were illuminated. The vehicle was towed to the dealer but was not yet diagnosed. The vehicle was not repaired. After investigating the failure, the contact related the failure to NHTSA Campaign Number: 24V104000 (Electronic Stability Control (ESC), Service Brakes); the VIN was included, but parts were not yet available. The manufacturer was not notified of the failure. The failure mileage was 14,000.

I am a new owner of a BMW X1. The design of the 2024 vehicle is problematic. I also own a 2022 BMW X3, that car is fine. This X1 has an infotainment system much like a Tesla and it creates a distracted driving situation. For example to deactivate that feature, which I do 100% of the time, that causes the stopped car to shut off takes one button press in the X3, in the X1 it takes 3. I have to press a button, find the deactivate on the screen then select the media button to go back to the radio. The whole time I am looking away or I have a passenger do it. To switch from say satellite to FM is similar but takes 5 on screen button presses. In the X3 I have buttons pre-programmed, no looking away. I cannot believe that this car was allowed to be built. I emailed BMW over a week ago and they did not reply. I am telling you because they can do better. This is just 2 examples there are other scenarios that force action to the screen in the car.

Thankfully, I have not been involved in an accident to-date, but my 2023 BMW X1 has been the subject of a recall involving its braking system since February 2024, with no available remedy as of August 15, 2024. The lack of urgency by BMW to fix an issue involving the safety of its customers and vehicles' occupants is startling. This is unacceptable. I request that NHTSA investigate this issue and hold BMW accountable for remedying the issue now as it has gone beyond a reasonable amount of time to fix the issue. If a fix is not available, BMW should be made to buy back my vehicle.

The auto start software will turn the engine off when the car is still rolling. I can be rolling 2-4 MPH and the engine will just turn off. There’s a huge delay after the engine restarts for power to continue. There is no way to permanently turn off this feature. If you are making a left turn across traffic you can be in a situation where the car will allow you to roll into oncoming traffic with the engine off. And as you press the gas nothing happens. It happens randomly so there’s no way to “learn” how the car behaves and anticipate it. In addition when the engine power does resume, it jolts forward and is sudden. The dealer has said there is nothing they can do as it’s BMW USA software. There’s no warning and no way to know that the engine is off. The software will only tell you when the car is at a full stop. Even then, the only indication is the small “ready” words. This is very easily reproducible by driving through several stop signs in personal mode.

FORWARD COLLISION AVOIDANCE: AUTOMATIC EMERGENCY BRAKING, SERVICE BRAKES, STEERING
Traveling about 35mph with no cars around, the brakes applied, no throttle response, and little steering. Warning lights illuminated and couldn't move car until turned off ignition and restarted. Dealer showed no codes and shows no record of it occurring. This symptom mirrors a recall on last years model, but not yet on 2024's. BMW says there's nothing more they can do but we are afraid to drive car because it's a guaranteed accident waiting to happen.

SERVICE BRAKES, FORWARD COLLISION AVOIDANCE: AUTOMATIC EMERGENCY BRAKING
The recall number for the incident is 24V-104. The car was recalled in February and the recall repair was completed May 2, 2024. The car is currently at BMW and is available for inspection.BMW has confirmed that the parts they replaced in May malfunctioned. They claim that some of the recall parts had a mechanical problem and that the recent repair, July, was done with parts that had been inspected. On July 22, 2024, I was backing up and when I braked the car jolted as if I hit something and the computer screen showed ABS and parking brake malfunction. When I engaged the brakes they were hesitant and took a long time to stop the car. Fortunately, I was in a parking lot with no cars around so there was ample space for the car to come to a stop. Had I been on the highway or main road, I would have been in an accident as I would not have had enough distance to stop.

POWER TRAIN, ELECTRICAL SYSTEM
The vehicle is equipped with a dual clutch transmission and has the EPA mandated auto-start feature. When you stop the vehicle and the engine shuts off and then remove your foot from the brake to go forward, the engine hesitates to restart and then starts, revs, dumps the clutch and propels you forward at a dangerous rate. My wife was trying to pull into the garage and stopped a little short. When she tried to move forward about a foot, the car started and lurched forward hitting the house. There is no way to disable the auto start feature and there are no buttons in the car. This is going to get someone killed when they are trying to make a left turn across traffic and first the car doesn't restart and then it starts and flies into traffic. I complained to BMW and they say this is the way the government mandates the car to be.

ELECTRICAL SYSTEM
The BMW 2024 X1 comes with the new iDrive9 that has eliminated most of the physical controls. Now there is a large touch screen that controls the radio, HVAC, Apple Car Play, cruise control, head lights, heated seats, etc. The driver has to keep looking at the screen to find the touch buttons to control all the operation functions of the car. Texting while driving is dangerous; well with the iDrive9, one is texting on steroids!!! This system is nothing short of dangerous. It is so bad, I got rid of the car after owning it for 7 months. I can't believe the NHTSA would allow such a system on a vehicle.
