VEHICLE SPEED CONTROL, FORWARD COLLISION AVOIDANCE: AUTOMATIC EMERGENCY BRAKING, FORWARD COLLISION AVOIDANCE: WARNINGS
Automatic braking and crash detection alarm failed causing collision with another vehicle, totaling the car. That was the third time it happened. The first two times I was able to get the vehicle under control before collision. Problem was never addressed at a dealership due to scheduling issues. Problem first appeared in May 2025, then in July 2025. Collision totaling the vehicle occurred on August 6, 2025.

I believe the issue is with the transmission by online research. I have had the issue multiple times. The vehicle sometimes hesitates to go when pressing on the gas pedal after being stopped at stop lights. This is a problem mostly when it is very hot outside. I have had multiple close calls when trying to take a right at red lights. I will have plenty of time before another car is coming but I try to go and the car hesitates or barely moves before it actually goes almost causing accidents. I have not been able to get the car to the dealer to try and reproduce the issue and I feel it would be hard to reproduce unless the car was driven for a bit in the heat. There are no codes or warning lights populating.

The contact owns a 2016 Nissan Rogue. The contact stated that while operating the vehicle, there was an abnormal whining sound coming from the front of the vehicle. The vehicle was taken to the local dealer, and it was determined that the sound was coming from the CVT transmission. The vehicle was later taken to the local Pep Boys Service Center which confirmed that the CVT transmission was faulty. The vehicle was not repaired. The manufacturer was notified of the failure, but no assistance was offered. The failure mileage was 67,000.

POWER TRAIN
When car is at a stop I need to press the accelerator all the way down for the car to go. It goes very slow (almost slipping) and feels very dangerous (risk of being rear ended). This started 2/3 weeks ago. My mechanic replaced the transmission fluid after finding metal particles in it. Also mentioned over a quart of transmission fluid was missing. They advised me to get a whole new transmission. I contacted Nissan consumer affair since there is a class action law suit for my Nissan Rogue. Mileage as of today it 84,400 miles. Car is being inspected as we speak. They did not find any code and it passed everything so I have to pay $730 for further inspection.

Nissan issued the recall on my vehicle. I took it into the dealership to be inspected. Was informed my car was one that needed to be fixed because of metal fragments on the dipstick in the oil. Was told Nissan had no remedy for the situation yet and had no idea when it would be available to be fixed. So I am expected to continue to drive a car that could stop working while driving and potentially cause a crash. It is absolutely unacceptable for them not to have a remedy for the situation or even know when they will.

The manufacturer was not made aware of the issue. The contact had not experienced a failure.

Subject: Failure of Nissan to Remedy Safety Issue Similar to Existing Recall – Nissan Rogue Dear National Highway Traffic Safety Administration, I am submitting this complaint regarding Nissan North America’s refusal to address a serious mechanical issue on my Nissan Rogue that is substantially similar to an existing recall. Despite the fact that my vehicle is experiencing the same symptoms and failures described in NHTSA Campaign, Nissan has declined to perform the necessary repair under the recall. Details: Vehicle: 2023 nissan rouge Mileage: 62750 Recall reference: Description of issue: My Rogue has exhibited loss of power which is identical to the condition Nissan has acknowledged in the recall. Nissan’s response: When I contacted my dealer and Nissan consumer affairs, they advised that my VIN is not included in the recall, even though the failure is the same as those vehicles covered. Safety concern: This issue poses a significant safety risk, as it stalling at high speed, inability to accelerate, the complete engine failure. The refusal to cover this repair leaves me with an unsafe vehicle and an undue financial burden, even though Nissan is aware of the defect. I respectfully request that NHTSA investigate Nissan’s handling of this matter and consider expanding the scope of the recall to include vehicles like mine that are experiencing the same hazardous defect.
