Classic Buick GMC (Classic Elite Buick GMC – Katy) Filed by: [XXX] [XXX] [XXX] Phone: [XXX] Email: [XXX] Date: November 23, 2025 Texas Attorney General – Consumer Protection Division RE: SUMMARY COMPLAINT – Vehicle Misrepresentation, Unauthorized Charges, Financing Fraud & Warranty Violations Dear Attorney General, I am filing this complaint against Classic Buick GMC (Classic Elite Buick GMC) located at [XXX] , for multiple violations of Texas consumer-protection laws during the sale and follow-up service of a vehicle I purchased in March 2024. Summary of Violations 1. Misrepresentation of Vehicle Model Year I was sold a 2023 GMC Yukon Denali that the dealership falsely represented as a brand-new 2024 model, including on the key-tag. This violates Texas Occupations Code §2301.351(a) and DTPA §17.46(b)(5), (7), (24). 2. Unauthorized Add-Ons & Hidden Charges The dealership added $8,000 in accessories and $26,000 in warranty products without my consent. This violates DTPA §17.46(b)(12). 3. Financing Fraud I was promised 1% financing, but the dealership charged a significantly higher rate at closing without disclosure. This violates the Truth in Lending Act (TILA). 4. Warranty Refusal & Pre-Existing Damage Although the vehicle had defects and mechanical issues at delivery, the dealership refused to repair them under warranty unless I paid. This violates the Magnuson-Moss Warranty Act. 5. Failure to Provide Required Documentation The dealership refused to provide complete purchase documents, violating Texas Administrative Code §215.142. 6. Pattern of Evasion I personally visited the dealership three times, yet management refused to correct any misconduct. 7. Unsafe Vehicle Retained at Dealership The Yukon remains at the dealership due to mechanical/electrical defects. I refused to pick it up because the vehicle is unsafe and not as represented. My brakes stopped working randomly. Alarms started going off in the car. Thankfully I was able to quickly turn right instead of rolling into traffic. This was terrifying and could have caused a very serious wreck.

Routine oil change by professional local mechanic. Upon completion we were told that the vehicle would not turnover. The mechanic diagnosed and found that were 2 recalls for our vehicle - one for the fuel pump module and one for the engine. We had our vehicle towed to the local GM dealership. They then replaced the fuel control module. GM tried to manually crank over but engine seized once again. We spoke to the GM Advisor prior to this and were told that our vehicle was not part of the engine recall because our VIN was not listed as part of it even though our vehicle had the same exact issues as described in the engine recall and was for the exact year/make/model of the engine. The dealer quoted us $14,896 to replace the engine. They stated they would submit a Goodwill claim to GMC to help discount the cost to repair/replace the engine. The dealer called back later that day and said GMC would be willing to cover 30% of the cost so our expense would be around $10,000. All this for a vehicle we've only driven for less than a year and a half. The vehicle went in for a routine oil change and has never had any issues prior to this. This happened suddenly without any sort of warning. To make matters worse, our powertrain warranty expired a day or two before this occurred. We are still trying to fight with GMC to cover this engine failure. The car has less than 75,000 miles and is only used for basic personal needs like driving to school and the store so it is shocking that the engine would suddenly fail like this and to make matters, the manufacturer refuses to take responsibility for it and to cover it under the recall even though there has been known widespread issues with this engine.

DuraMAX 3.0L LZ0 engine with defective crankshaft thrust bearing caused catastrophic engine failure requiring engine replacement. The event occurred at about 1,000 miles. There is a GM TSB that addresses this issue. This failure displayed all of the symptoms as described in the Technical Service Bulletin (TSB) 25-NA-307. The engine has been replaced by GM. There was only one cryptic dashboard message that "acceleration may be reduced", that briefly appeared and then disappeared, three days before the incident. With no check engine light, the mysterious message was chalked up to possibly a DEF low warning. DEF was added. The vehicle displayed no problems during those three days -handling normally. Then while at interstate speeds approximately 90 miles later, the warning that "acceleration is limited" flashed and the vehicle went into limp mode, shortly thereafter the check engine light illuminated. OnStar read the code - P06DD. The email from them stated the recommended action: "Service within 7 days." The following morning the vehicle was presented to a GM dealership service department. Loud "knocking" noises were originating from the rear of the engine compartment at that point in time. The service department reported the engine needed replacement and did so.

The contact owns a 2023 GMC Yukon XL. The contact stated that while driving approximately 25 MPH and depressing the brake pedal, the vehicle failed to respond. Several unknown warning lights were illuminated, and the message "You Have no Brakes - Do Not Drive Over 40 MPH" was displayed. The contact allowed the vehicle to roll to a stop. The contact turned off and restarted the vehicle, but the failure persisted. The contact parked the vehicle. The contact stated that the failure had not caused an accident because the contact was driving early in the morning and there was less traffic on the road. The contact stated that her husband started the vehicle later in the day, and the warning lights were off. The vehicle was driven to the dealer to be diagnosed. The dealer diagnosed the vehicle and informed the contact that several DTCs were retrieved, including a DTC for brake failure; however, the flow chart from the manufacturer instructed to first replace the battery and then reset the codes. The dealer replaced the battery, reset the codes and test-drove the vehicle. The vehicle was repaired and returned to the contact. The manufacturer was notified of the failure and supported the dealer's assessment. The failure mileage was approximately 70,000.

I am writing as the owner of a new 2025 GMC Yukon XL AT4 VIN: [XXX] , purchase date: 01AUG2025, from Elizabeth City GMC, Elizabeth City, NC. This vehicle, equipped with the 3.0L Duramax diesel engine and Super Cruise hands-free driving assistance, was purchased for safe family travel, including space for my wife, our 21-year-old daughter, and our family dog(s). At approximately 4,300 miles—well within the 3-year/36,000-mile bumper-to-bumper warranty—this truck suffered a catastrophic right-rear brake failure directly attributable to a dealer-installed GMC-approved Brembo Performance Brake Upgrade Package, resulting in a near-fatal highway incident and profound emotional hardship for my family. The contact owns a 2021 GMC Yukon XL. The contact stated while driving at an undisclosed speed, the low engine oil warning light illuminated. The contact checked the oil dipstick and noticed that the oil level was extremely low. The contact stated that the vehicle was serviced by the dealer a month prior, and the oil change was performed. The contact stated that the oil level required to be topped off several times while driving the vehicle to the dealer. The vehicle was taken to the dealer, where an oil consumption test was performed, and the vehicle was diagnosed with engine failure. The contact was informed that the engine needed to be replaced. The vehicle was not repaired. The contact referenced an unknown recall with a similar failure description; however, the VIN was not included in a recall. The manufacturer was not made aware of the failure. The failure mileage was approximately 74,500.

- #11697902November 6, 2025FUEL/PROPULSION SYSTEM
While driving northbound on I2 at approximately 70mph I experienced a sudden loss of engine power. Vehicle would not accelerate and engine ultimately powered off. I was able to move across three lanes of traffic and pull over on the side of the highway. I attempted to restart the vehicle but was unsuccessful and after about 10 minutes the engine managed to start. The ‘check engine’ light was on after the incident and upon arriving back home I ran a code scan that resulted in code P129F indicates a problem with the fuel pump control module. There is recall #N252516900 dated 9/11/2025 which covers this issue for 2021 models only. This occurred on a 2023 model.

While traveling on the interstate my vehicle shuttered and lost power we went to a friend’s neighborhood and the vehicle stalled when we pulled in no lights had come on until then and a knock had started. With no where to pull over I finally got the vehicle started and drove it straight to our friends house and left in on the side of the street. I had to take there vehicle home and called ONSTAR to tow it to the dealership. I have to pay for the over mileage because I was out of town when it happened.

The vehicle underwent a recall inspection on September 8, but on October 2, the vehicle still experienced a serious engine failure. The vehicle was undrivable, and the dealer inspected it and opened a TCA case. However, General Motors stated that it had passed the recall test and was not covered under special warranty, and asked me to pay $5,000 for vehicle repairs. I believe this is an engine malfunction related to the recall, and the manufacturer should replace the engine for me free of charge and refund my 5,000 .

The vehicle has experienced numerous losses of power, it has nearly stalled during normal operation, there is a horrible knocking noise coming from the engine. I have had the vehicle into the dealership who state they are unable to recreate the issue, and since the vehicle has been turned off the recorder shows noting either. They have performed an inspection and changed the oil, but the vehicle still has the issue. It knocks and shudders like it's cold, it comes very close to stalling and then seems to recover, this has happend twice while making left hand turns, it has completly lost power even while depressing the gas, but again they indicate they can't recreate it, so there is nothing they can do. I am scared for my safety, and that of the child I drive daily. There have been several instances in the last few months.

- #11696961November 1, 2025FORWARD COLLISION AVOIDANCE: AUTOMATIC EMERGENCY BRAKING, FORWARD COLLISION AVOIDANCE: WARNINGS
This issue affects all vehicles in the GMC lineup. The forward collision alert system is so sensitive that it gives false positives constantly which causes 2 major safety issues with the vehicle. First is that it brakes without warning and when completely unnecessary. The 2nd is that vehicles like mine with a heads up display, have the entire display flash a very bright yellow blocking the field of vision to the front of the vehicle. The system is not able to be disengaged permanently and can cause rear end collisions by braking when no obstacle exists and blocks the ability to see in front of you via the heads up display warning.

On May 23, 2025, I purchased a 2023 GMC Yukon XL VIN: [XXX] from the GMC dealership. At the time of sale, I specifically asked about the active GM engine recall. They assured me the vehicle had been inspected and was unaffected. On October 30, 2025, the engine catastrophically failed on a highway while my family — including my two small children — were in the vehicle. This created a dangerous emergency situation as I had to avoid high-speed traffic. INFORMATION REDACTED PURSUANT TO THE FREEDOM OF INFORMATION ACT (FOIA), 5 U.S.C. 552(B)(6)

GM's 2021/2024 6.2 engine recall began with vehicle production March 1st, 2021. My Yukon XL Denali was produced Feb 26, 2021, THREE days before the recall start. The engine was replaced by GM approximately 6/21/2023 (previous owner), the replacement engine was built the 129th week of 2023. With my recent call to GM, they only reference the original vehicle's build date. If my vehicle missed that by three days, and now has another engine built during this recall period (2023), they have no help for me, it is NOT covered in this safety recall. Neither GM or my dealer has been able to tell me which oil to run 0w20 or 0w40. This vehicle's engine failed just outside of the current recall dates. With the expansion of dates, I can have my motor inspected and be covered under the extended year and milage warranty given to other owners. I am requesting NHTSA to expand the existing recall date. Thank you.

- #11696119October 28, 2025EXTERIOR LIGHTING
ChatGPT said: There is a design flaw with the automatic light function. When you turn the knob to disable the automatic lights to avoid blinding someone while parked, the knob returns to the auto position as expected. This is a good system to ensure that the next time you start the car, the lights are in auto again. The issue is with the way the system indicates what is happening to the driver. When the lights are set to auto, the “auto” indicator on the knob is illuminated. If you turn the knob to running lights or full lights, the corresponding indicator lights up as expected. However, when you turn the lights off, the indicator light returns to “auto” even though the lights are actually off. While the physical knob should return to auto to make sure the system resets properly at the next startup, the indicator should switch to the “off” position so the driver knows the lights are off. I drove off in the city and assumed my lights were on because the knob said auto, but I later realized they were off. This creates a serious safety hazard. There is no way to know in that situation if your lights are actually on by looking at the knob unless you cycle the lights again. A recall should be issued to change the software or replace the button to make sure that this is clear to the driver.
