I have a code Passanger restraint failure that will not come off unless I pay $2700 to fix. This coding came on after 3 months of getting the vehicle and I’m not the only with the same issue. This is a dangerous situation that Bmw is not recalling but putting this as the owners expense. If I were to get in an accident this will not deploy airbags or open the seat belt this can cause sever injuries or worst death.

Subject: Urgent Issue with EVAP System Failure Dear Safety Highway Control, I discovered that the EVAP system in my car has failed, confirmed by a computer diagnostic at the Body Shop. The dealer mentioned no recalls, so I contacted the recall department who advised me to contact you. The check engine light has been on, prompting this urgent report. Your prompt investigation is greatly appreciated. Sincerely, [XXX] INFORMATION REDACTED PURSUANT TO THE FREEDOM OF INFORMATION ACT (FOIA), 5 U.S.C. 552(B)(6)

The system fails to alert the driver of any cross traffic activity. it only works when backing into something that is directly in its path. I have taken the car to Laurel BMW Westmont, IL they have confirmed the vehicle settings are correct. I also contacted BMW corporate and spoke to a customer service agent who basically admitted that they are aware of the problem but have no fix in the works. Independent of all this I see where there are a number of folks who have commented on various social media platforms that the BMW cross traffic alert system does not work. I almost got into an accident because of it. Seems like something that should be recalled and fixed. It's pathetic that a car that costs this much does not meet this industry standard.

I went to hospital several times - the car had defect of manufacture- gas fume released inside the car every time i drove the car I had nausea, drowsiness, vomiting because the car at the beginning was new I never assume the car was causing me illness which had a tremendously impact in to my health. I had to buy new cloth, new mattress and changed the carpet. My health was also impacted - I was diagnosed with granulomas on my lungs. the fume is clear, the cloth will smell gas, and particles of gasoline hazard will attached to the skin giving an allergic sensation. This almost killed and I was not aware that the car was causing this impact on my daily life.

- #11607948August 12, 2024SERVICE BRAKES, UNKNOWN OR OTHER, FORWARD COLLISION AVOIDANCE: AUTOMATIC EMERGENCY BRAKING
I am a [XXX] physician who has been driving for about 30 years. Purchased this vehicle as a CPO with VIN as identified above. It is a 2024 BMW 530i X-drive from Faulkner BMW in Lancaster, PA. It was delivered on July 25, 2024. I have only put approximately 200 miles on in it since delivery. On Thursday, [XXX] there was catastrophic failure of the vehicle. At around [XXX] I was driving North on [XXX] about to make a right turn onto [XXX] for work at the Hospital System where I am employed. The traffic light was red and I was going about 5 miles an hour and attempted to brake the car. There was an 18 wheeler truck about 10 to 15 feet ahead of me. My car instead of braking underwent unintended acceleration. Despite my efforts to slam on the brake, the car was accelerating. None of the safety features including automatic emergency breaking were activated. Unfortunately I collided with the 18 wheeler. This was fortunate in some regards as I could have potentially struck a pedestrian or a motorcycle and have had a potentially fatal event. Please note that additionally my airbag did not deploy. The BMW dealership was contacted. They dropped off a loaner vehicle and picked up my vehicle in a flat bed for investigation. I was informed to contact BMW of North America which I did. Interestingly enough, there were no safety recalls on this vehicle on [XXX]. The car is at the BMW dealership in Lancaster PA for their internal inspection. I am being informed that the engineers are looking at the vehicle to find out what transpired. Interestingly enough, I did receive a phone call from the service manager advising me on August 9 that there was a safety recall as a relates to the brakes. As I review the NHTSA site, there is now a recall on my actual vehicle's braking system. I did a review of unintended acceleration and found multiple complaints. BMW is looking into this although into this, but external agency would be ideal. INFORMATION REDACTED PURSUANT TO THE FREEDOM OF INFORMATION ACT (FOIA), 5 U.S.C.

RCTA system does not work (other than on rare, unpredictable occasions, and generally only when the alert is worthless) - when another vehicle or pedestrian is too close to the car to make any difference. I have had cars with RCTA for years and none of them failed to detect objects/vehicles/people at much greater distances from my vehicle that could reasonably be expected to collide with my vehicle if I continued to back up. All these other cars provided an adequate advance warning of an impending danger (another car, bike, pedestrian, etc. approaching my vehicle with which I might collide, etc.) allowing the driver to react and avoid the problem. THIS PROBLEM OCCURRED REPEATEDLY STARTING IMMEDIATELY AFTER I TOOK POSSESSION OF THE CAR IN MARCH 2021. After repeated attempts to get BMW to fix the problem, I gave up. I will note the first serious occurrence of the issue below, but it has been repeated every time I use the car and pull out of a parking space in reverse. Probably 150 times? I can compensate for this failure somewhat, but it is vastly inferior to having a properly working RCTA. I have visited BMW dealerships on multiple occasions and each time asked that this issue be addressed. The car is reviewed, and I am told the system is working as designed. My response is that the car is therefore designed to be unsafe? However, on my latest visit for regular service (24 months since start of lease) I went to a different dealership, the service advisor told me that the problem was widespread in BMW 5 series sedans and SUVs. He indicated that there is no fix available at this time. It's been two years since I brought this to BMW's attention. Service Invoice that I am attaching is from March 3, 2022 - one of the trips to the dealership to get regular service where I asked again that this issue get addressed. See Item # 4 on pages 1 and 2.

The glass roof suddenly exploded while driving, there was a no visible damage on the glass as the sunshade was open and I inspect the glass for any cracks or chips, there were no cracks or chips. The outside temperature was 35 degrees, time as approximately 9:30 PM on a major highway with a smooth surface, and light traffic. The explosion did not occur while going under an overpass, there was no sound of any pebbles being pinged against the car, again traffic was light. Glass was not laminated as it is in a windshield, glass chips flew inside the vehicle which is very dangerous.

We were involved in a car accident. We were traveling through a traffic circle. The other car that was entering the circle failed to yield or even slow down and hit my car. The rear passenger side door was hit. I was driving and thrown into the driver door and my hip is injured. My son was riding in the back seat behind the driver and he was knocked into the window and was knocked unconscious. I was wondering why the side airbags did not deploy. I reported this to my local dealer who sent me an article about side airbags. There were no warnings or indications anything was wrong with any of the systems. It is a 2022 model car.

- #11465809May 23, 2022SERVICE BRAKES, UNKNOWN OR OTHER, VEHICLE SPEED CONTROL:ACCELERATOR PEDAL
After pulling into a parking space and stopping, the braking system became unresponsive. While stopped with the foot on the brakes, attempts to place the car in park failed. After pumping the brakes, the car rolled forward as the car idled and the brakes were unresponsive as it rolled through a corrugated metal wall and the car only stopped after pressing the ignition button to turn off the car, putting anyone in or near the car at that time at risk. The problem has been reported to the dealer and the dealer inspection is pending but the problem has not been isolated and not reproduced. No prior warning lights or symptoms of a problem was noticed in this car before this incident.

Design of acceleration pedal and seat are causing me leg pain and causing my leg to fall asleep while driving. This is dangerous. There is too much resistance of pedal and lots of force needed to accelerate car.
