The contact owns a 2011 BMW 328I. The contact stated that while driving at various speeds, there was a burning odor coming from the vehicle. The odor was more prominent while the vehicle was idling. The RPM fluctuated while idling, causing the vehicle to stall. The contact would depress the brake pedal, place the vehicle in neutral, turn off, and restart the vehicle to accelerate and continue driving. The air bag warning light was illuminated, and the message, "Check Engine Soon," was displayed. The vehicle was taken to a certified mechanic, and a diagnostic code was retrieved for Positive Crankcase Ventilation (PCV) failure; however, no repairs were completed. The contact completed some research and learned that the failure could be occurring due to air entering the brake lines. The contact also found information about NHTSA Campaign Number: 22V119000 (Engine); however, the VIN was not included. The vehicle was not taken to the dealer, diagnosed, or repaired. The manufacturer was not informed of the failure. The failure mileage was approximately 133,000.

2010 bmw 328i xdrive: Had in for recall PCV 1/08/2025. This vehicle has had a prior recall for same issue before i owned in 2014. Motorwerks BMW failed to complete recall, as parts and repair bulletin from BMW OF AMERICA has parts list. Motorwerks just CHOSE to put items, subtitled under other services/self pay. When I asked about this they responded that CAR WAS OUT OF WARRANTY ....as build date put it a year out? A RECALL IS A RECALL ITS FOREVER, OR THE LIFE OF CAR. not when they the dealer/shop and BMW right? i have filed and called and complained to numerous places including NCDS, BMW of AMERICA and have gotten no traction or reasonable response. Now I'm having VANOS related issues, serious issues, but no recall listed?, even though the year and style and build date put it in parameters of SAFETY RECALL not just manufacture voluntary recall.

RECALL OMISSION & SAFETY DISPUTE (Case #10683843): I am reporting two documented safety defects in my 2008 BMW 328i (N51 engine) that are identical to existing Federal Safety Recalls but have been omitted from the recall VIN list for this model year. 1. AIRBAG SYSTEM FAILURE (Recall 17V-428): The vehicle has a confirmed Fault Code 93C3 (Passenger Seat Occupancy Mat). This is the exact failure mode described in Recall 17V-428. This defect has deactivated the front passenger airbag system, as indicated by the red SRS warning light. The manufacturer has refused to address this as a safety recall, despite the component failing in the identical manner described in the 2006 model year recall. This creates an immediate risk of injury or death to front-seat passengers in the event of a crash. 2. ENGINE STALL RISK (Recall 23V-707): This vehicle utilizes the same aluminum VANOS housing bolts that are currently under Safety Recall 23V-707 for 2010–2012 models. These bolts are known to loosen and shear, causing sudden engine stalling while in motion. Despite the high risk of a high-speed stall and loss of power steering/braking, the manufacturer is excluding 2008 models from the recall remedy. DEALER/MANUFACTURER RESPONSE: The vehicle was inspected by a dealer in October 2024 (Invoice #156201), but the safety warning light was not documented on the repair order. A subsequent formal request for assistance (Case #10683843) was denied verbally by the manufacturer's regional management, who stated the vehicle is excluded from the recall based on its VIN, regardless of the active safety system failure. I am requesting a formal investigation into this Recall Omission to ensure these safety-critical repairs are provided to all affected vehicles.

My 2015 BMW 328i has a broken "plastic" parking brake cable bracket. It breaks so often on the BMW lineup of cars that businesses have made better work-arounds to fix the problem than a plastic part. A fantastic video explain it can be found at AGATools.com search BMW parking brake. It is on Youtube as well. When the plastic parking cable holder breaks, which it will, BMW has to lower or remove the gas tank to fix a $5 part...the labor is over $800. The parking brake cable becomes loose and wears on the drive shaft, making noise throughout the cabin, but more importantly will wear and fail over time.

On November 17, 2025, my 2015 BMW 328i (VIN: [XXX] ) caught fire while parked, locked, and turned off inside my enclosed residential garage in Irvine, California. The vehicle had been parked for approximately 90 minutes prior to the incident. No flammable materials were stored in or around the vehicle. Responding police and fire personnel identified the vehicle itself as the source of the fire, with ignition originating in the engine bay. The building’s fire sprinkler system activated, and residents were evacuated due to smoke and fire conditions. No injuries occurred, but the incident posed a serious risk to life and property due to the residential setting. The vehicle was a total loss. While the exact technical cause of ignition could not be determined at the scene, first responders confirmed that the fire originated within the vehicle’s engine compartment. BMW of North America was notified of the incident and represented that an inspection would be coordinated. I remained in contact with all involved parties and relied on BMW’s stated intent to contact the tow facility directly to arrange inspection. Despite this, BMW did not make contact with the tow company prior to the vehicle’s disposal. After the vehicle had already been sold by the tow yard, BMW indicated that coordination had not occurred and that inspection was no longer possible, resulting in loss of physical evidence. This complaint is submitted due to concern regarding a vehicle fire occurring while the vehicle was not in operation, inside a residential structure, and due to the manufacturer’s handling of the matter in a way that prevented timely inspection and meaningful safety review despite early notification and cooperation. The vehicle’s "Passenger Airbag Off" light and dashboard SRS warning lamp are illuminated. A diagnostic scan using a BMW-specific tool confirms manufacturer Fault Code 93C3 (Passenger Seat Occupancy Detector). This indicates a hardware failure of the OC3 internal seat sensor mat. Safety Risk: The failure of this sensor prevents the vehicle from correctly identifying if an adult is in the passenger seat. This compromises the Supplemental Restraint System (SRS) and may result in the passenger airbag failing to deploy during a collision, posing a significant risk of injury or death to the occupant. Confirmation of Problem: The fault was confirmed via a digital diagnostic system (Foxwell NT510) which identified the specific "Open Circuit" within the seat mat. The component is currently installed in the vehicle and is available for inspection. Connection to Existing Recalls: This failure is identical in symptoms and fault code to those described in NHTSA Safety Recall 17V-428. Although this vehicle is the same year and model (2008 BMW 3-Series) as those covered in the recall, the VIN was excluded from the initial recall range. This appears to be a recall omission of a known manufacturing defect, as the failure occurred despite minimal use of the passenger seat.

INCIDENT SUMMARY: On January 9, 2026, at approximately 1:30 PM, while traveling at 50 MPH in North Carolina, the vehicle experienced a sudden, catastrophic engine seizure without any prior "Limp Mode" warning or Check Engine Light. This resulted in an immediate, total loss of motive power in active traffic. I was forced to navigate a dead multi-ton vehicle across lanes without power steering or vacuum-assisted braking, narrowly avoiding a high-speed collision. TIMELINE & NEGLIGENCE: This vehicle was purchased from an independent retail dealer on December 20, 2025—less than 21 days prior to this life-threatening failure. The vehicle was sold with an "Open" status for Safety Recall 23V-707. The failure occurred exactly as described in the recall’s warning: a catastrophic stall at speed. TECHNICAL EVIDENCE: A non-invasive borescope inspection of the cylinders has confirmed the presence of metallic "silver chunks" (sheared bolt heads) and "half-moon" impact marks on the piston crowns, indicating a total timing failure and internal mechanical collision (piston-to-valve contact). REQUIRED REMEDY: This incident is a direct manifestation of the safety risk documented in Recall 23V-707. Per BMW Service Bulletin SIB 11 09 23, the presence of sheared bolt heads and seized internals constitutes "Catastrophic Consequential Damage." I am filing this report to ensure federal oversight of BMW North America’s obligation to provide a complete engine replacement, as the safety defect was present at the time of sale and resulted in a near-fatal incident within 300 miles of ownership.
